Summary

The facility failed to implement effective interventions and supervision to protect one resident from resident-to-resident abuse when a roommate with a documented history of verbal aggression and threats struck the resident on the legs. The roommate had diagnoses including blindness in one eye, anxiety disorder, muscle weakness, and cataract, and his records showed repeated complaints about the roommate’s TV volume, yelling, and attempts to enter the other resident’s personal space. Notes also documented prior statements that he wanted to beat the roommate up, along with psychiatric follow-up describing irritability and anger triggered by environmental stressors such as roommate noise and rule-related conflicts. The incident occurred after ongoing conflict between the two roommates over television volume and use of the remote. Records showed that staff had previously documented the roommate’s agitation related to the other resident’s TV, including yelling at staff, trying to hit a sitter, and trying to get into the roommate’s personal space. The struck resident, who had hemiplegia, dysphagia, muscle weakness, aphonia, and moderate cognitive impairment, reported pain rated 3 out of 10 and later pointed to his legs while crying and stating he was scared and sad. He also reported that the roommate had yelled and threatened to hit him in the face multiple times before the incident. Interviews with staff confirmed that the roommate had a long history of aggressive behavior toward the other resident and that staff were aware of the conflict before the physical altercation occurred.
