Missing Medicare Non-Coverage Notice Documentation
Summary
The facility failed to ensure that the Notice of Medicare Non-Coverage (NOMNC) and the Skilled Nursing Facility Advance Beneficiary Notice of Non-Coverage (SNF ABN) were completed and that documentation was maintained showing delivery of the notices to the resident and/or responsible party for one sampled resident. The deficiency involved Resident 90, and the missing documentation meant the record did not show how the beneficiary notices were provided. During interview, the MDS Nurse stated the process for issuing a NOMNC began in weekly interdisciplinary team meetings, where the team identified the last covered day when a resident met goals and was safe for discharge home. The MDS Nurse stated she created the NOMNC and gave it to Social Services for completion, and Social Services then notified the resident and/or responsible party and began discharge planning. The Social Services Assistant stated her department was responsible for issuing beneficiary notification forms and said the record showed the NOMNC was issued for Resident 90, but she could not explain what form documented telephonic delivery of the NOMNC. The Social Services Assistant stated she used a signed document when verbally delivering the SNF ABN by telephone, but she was unsure how the NOMNC was delivered. She stated she would normally document delivery in a progress note, but no progress note was found in the EHR showing how either notice was delivered. She also stated the SNF ABN had not been completed beyond the resident's name. The Administrator stated his expectation was that the NOMNC should have been completed and signed, the SNF ABN should have been completed, and any mailing of the notices should have been documented in a progress note. Facility policy stated residents are informed of changes in covered services as soon as possible, written notices are provided in person when possible, and a copy is provided immediately after the notice is signed.
