Late and Improper Medicare Non-Coverage Notice
Summary
The facility failed to provide one of four sampled residents with adequate notice of Medicare non-coverage. Resident 1’s record showed intact cognition with a BIMS score of 15 out of 15, and the resident’s admission record and MDS were reviewed during the survey. The NOMNC in the record was dated 4/11/26, listed the resident’s name incorrectly, and stated that Medicare coverage of current skilled nursing services would end on 4/13/26. The form also showed “Refused to sign” on the patient/representative signature line, with signatures entered by the SSD and an RN. Progress notes documented that the resident received a Notice of Medicare Non-Coverage and refused to sign, was given a copy, and that social services discussed the appeal process with the resident and the resident’s brother by phone, including the Livanta QIO contact information. A second social services note, later marked invalid, similarly stated that the resident refused to sign, received a copy, and was spoken to directly about the Medicare decision and discharge planning. During interview, the Ombudsman stated the resident reported receiving the NOMNC from the SSD and was unsure who signed it. The resident stated the notice was not explained thoroughly and that assistance in completing it was not offered. During interviews, the SSD stated she was not involved in the resident’s case as the Administrator was primarily handling social service duties and said she did not have a copy of the NOMNC or information about delivery to the resident. The resident stated family helped complete the appeal because the notice was delivered late. RN 1 stated she had never signed a NOMNC and was not involved in the discharge plan, while the Admin stated the SSD delivered the NOMNC but could not confirm the date. The facility policy stated the NOMNC must be delivered at least two calendar days before Medicare-covered services end or the second to last day of service if care is not provided daily.
