Resident Held Down During Refused Care

Summary

The facility failed to ensure a resident was free from the use of physical restraints when two CNAs held the resident down during personal care after the resident repeatedly refused the care. The resident had diagnoses including malignant neoplasm of the ovary, liver, and bile duct, morbid obesity, widespread metastatic disease, generalized weakness, severe debility, and required extensive assistance with ADLs. The resident also had a PleurX catheter to the right abdomen and reported moderate pain at the catheter site. The resident was bedbound, had clear speech, and had no cognitive impairment or disorganized thinking. During the early morning care episode, two CNAs entered the resident’s room to provide perineal care and change an incontinent brief. While the resident was being turned and cleaned, she became increasingly agitated, yelled that they were killing her, and repeatedly asked them to leave her alone and stop touching her. One CNA continued to hold the resident in a side-lying position while the resident struck her, and the other CNA restrained one of the resident’s hands and then both arms when the resident continued to move and resist. The CNAs continued the care despite the resident repeatedly saying no and asking them to stop. The resident later reported that two CNAs attempted to hold her down while providing care and stated she felt physically assaulted. In interview, the resident said the turning caused extreme pain and that she did not feel safe in the facility. The CNAs stated they continued because they were focused on completing the care and did not want to fall behind, and one CNA stated they felt short-staffed. The Administrator stated that if a resident was refusing care or saying no while care was being attempted, staff should respect the refusal and stop the care. The facility’s policies defined restraints as any manual method that restricts freedom of movement and stated restraints were not to be used for staff convenience.
