Summary

The facility failed to ensure a resident with COPD and acute respiratory failure with hypoxia received care in accordance with physician orders during an emergent change in condition. The resident’s order summary directed oxygen via nasal cannula at 3 LPM continuously every shift, but a licensed nurse documented the resident on 2 LPM with oxygen saturations of 70-80%. The nurse later stated the resident was sitting on the bed with those low saturations, acknowledged that this was a critical level, and stated 911 was not activated until approximately 1:30 p.m. The nurse also stated she increased the oxygen to 4 LPM with no improvement, and the resident was transported to the hospital and died. The nurse also did not follow standing physician orders for PRN Albuterol Sulfate inhalation aerosol and PRN Torsemide for shortness of breath. The medication administration record showed no documentation that Albuterol had been administered from May 1 through May 19, 2026, and Torsemide was also not administered when the resident had documented shortness of breath. The DON stated the resident should have received the ordered PRN medications at the first sign of respiratory distress or shortness of breath. Documentation of the resident’s change in condition was also contradictory and inaccurate. The nurse documented at the same time that the resident had oxygen saturations in the 70s with shortness of breath on exertion, while another note stated the resident was breathing even and unlabored. A later progress note stated there were no signs of difficulty breathing while also stating shortness of breath was noted and observed. The nurse acknowledged her documentation was not chronologically documented and was inaccurate, and the DON agreed the documentation should have been chronological and accurate.
