Summary

The facility failed to make prompt efforts to resolve a grievance and failed to issue a written decision/response for resident #33, despite its grievance policy requiring grievances to be received, tracked through conclusion, investigated as needed, and resolved with written decisions. Resident #33 was admitted with diagnoses including paranoid schizophrenia, essential hypertension, chronic obstructive pulmonary disease, and idiopathic progressive neuropathy. The quarterly MDS dated January 20, 2026 showed a BIMS score of 15, indicating the resident was cognitively intact, and noted no potential indicators of psychosis, with verbal behaviors and other behavioral symptoms not directed toward others occurring 1-3 days. The care plan included a focus area noting that the resident and his representative had chosen to engage in a behavioral contract. A grievance form dated August 25, 2025 for resident #33 documented concerns that staff yelled at the resident, called him a liar, bullied and demanded of him, accused him of desertion of post, called him racist/lazy, and accused him of assault; the form also noted two witnesses and indicated immediate corrective action was required, with staff to be reprimanded and reassigned from the south hall. During interview, resident #33 stated that staff bend the rules to their advantage, that he is not heard, and that he had filed 3 grievances without hearing back about the outcome. The Social Services Director stated he was responsible for grievance forms, generally met with residents the same day, and would forward grievances involving nursing staff to the DON, but he found no documentation in the EHR showing the grievance had been given to the DON or showing the outcome. The DON stated grievances are logged, resolved, and the outcome reported back to the resident, but she was not aware of any grievances from resident #33 in the past year and said that if she did not receive the form she would not be able to conduct an investigation. The facility policy stated that grievances are received, tracked through conclusion, investigated as needed, and that written grievance decisions are issued.
