Summary

The facility failed to ensure that a resident representative was notified after a resident experienced an accident involving a fall. Resident #21 had diagnoses including cerebral infarction, COPD, type 2 diabetes, chronic osteomyelitis, acute embolism and thrombosis, pulmonary hypertension, metabolic encephalopathy, a sacral pressure ulcer, mood affective disorder, iron deficiency anemia, hypothyroidism, benign prostatic hyperplasia, and chest pain. The record also showed a POA document naming the resident’s son as the health care surrogate, and the resident’s MDS reflected a BIMS score of 13, indicating intact cognition. An incident note documented that the resident was found on the floor in his room after yelling for help and stated that his legs buckled while he was trying to get up to go to the bathroom. The note stated that he was barefoot, did not use his call light, and had no visible injuries at that time. Team health and the DON were notified, but there was no evidence in the note that the POA was notified of the fall. Subsequent documentation showed the resident later developed increasing pain after the fall, refused wound care because of pain, received multiple doses of oxycodone for pain in his legs, feet, lower back, hips, thighs, and knees, and later reported that he was unable to bear weight on his right leg. A health status note later documented that the NP was notified, the POA and resident wanted transfer to the ER, and EMS arrived to transport the resident for a hip injury. Interviews with staff confirmed that the son was the resident’s POA and should have been notified of the fall, even when there was no immediate injury. The DON stated that staff were expected to notify the POA of falls and other changes in condition, that notification should generally occur within an hour, and that there was no documentation showing the POA was told about the January 16 fall. Facility policy also stated that the resident, attending physician, and resident representative were to be promptly notified of changes in condition and that the resident representative should be notified when the resident was involved in an accident or incident unless otherwise instructed by the patient.
