Failure to Protect Residents from Resident-to-Resident Physical Abuse
Summary
The facility failed to protect two sampled residents from physical abuse by other residents. One resident was admitted with diagnoses including acute and subacute infective endocarditis, schizoaffective disorder, anxiety disorder, chronic viral hepatitis C, and other psychoactive substance abuse, and had orders for behavior monitoring and anxiety-related medications. Another resident was admitted with diagnoses including acute osteomyelitis of the right ankle and foot, schizophrenia, and psychoactive substance abuse, and had orders for behavior monitoring, pain medication, and antipsychotic treatment. Both residents were documented as cognitively intact on MDS assessments, and both had care plan revisions related to psychosocial well-being and potential behavior problems related to physical altercations. The investigation for the first incident showed that the two residents were involved in a physical altercation in which one resident was observed with hands on the other resident's neck. Staff interviews and the facility's investigation confirmed that the resident grabbed the other resident's neck and shirt after stating the other resident was making fun of him. The facility completed skin assessments, placed 1:1 supervision on the resident identified as the aggressor, ordered psychological evaluations, notified police, and determined the event was isolated and unanticipated. The DON stated that resident-to-resident altercations require separation of the residents, assessment, interviews, and interdisciplinary review, and acknowledged that failure to investigate and care plan appropriately could cause fear and harm to other residents. The second incident involved two other residents, one with depression, anxiety disorder, and hyperlipidemia, and another with anxiety, bipolar disorder, and schizophrenia. A facility investigation documented that one resident reported being scratched on the face and arm by the other while retrieving a hat from a closet. The investigation also recorded that a CNA witnessed one resident hit the other in the back of the head and separated the residents, then notified the DON. The facility later verified the event as an unanticipated incident and documented a care plan focus for the resident involved in the altercation. Staff interviews described resident-to-resident abuse as physical abuse and stated that staff should separate residents, notify nursing leadership, and ensure safety when such events occur.
