Summary

The facility failed to ensure the transfer or discharge of one resident met the requirements for transfer/discharge after determining the resident would not return to the facility following hospitalization. The resident was admitted with pneumonia due to MRSA, COPD, and acute and chronic respiratory failure with hypoxia, and had no advance directive or durable power of attorney for medical decisions. Records also showed the resident was cognitively intact, but had chronic delusions, chronic resistance to care, and was verbally abusive when not getting what he/she wanted and when staff followed rules. On 5/21/26, staff documented escalating behavioral and psychiatric concerns. Nursing notes recorded that the resident made statements about having shot someone before and then shooting them multiple more times. Social services documented that the resident reported severe pain, refused PRN pain medication, became verbally escalated during discussion about therapy participation and room relocation, and made threats including, “I will kill you,” along with suicidal statements. The NP ordered transfer to the ER for suicidal ideation, homicidal ideations with plan verbalized, and uncontrolled pain. The interdisciplinary team documented that the resident’s care needs exceeded the facility’s capability to provide safe and appropriate management, and the resident was transferred to the ER by EMS after declining to sign the transfer notice. After the hospital later sought to return the resident to the facility, the facility declined readmission because staff believed the resident remained unsafe to self and others. Social services documented a discussion with the hospital’s mental health specialist stating the resident was unsafe based on recent behaviors and direct statements, and that the threats toward staff and self-harm statements exceeded what could be safely managed in the setting. The administrator stated the facility did not follow up with the hospital after declining readmission and acknowledged communication essentially ceased. The record also showed no second discharge notice after the facility determined the resident could not return, and the facility acknowledged it did not complete a corrected PASRR screening or request a Level II PASRR evaluation after psychiatric concerns were identified.
