Failure to Obtain Physician Order for Supplemental Oxygen

Summary

The facility failed to obtain a physician’s order for supplemental oxygen for Resident 25, even though the resident was receiving oxygen therapy after readmission. Resident 25 had multiple diagnoses including acute kidney failure, type 2 diabetes mellitus, anemia, acute metabolic acidosis, dementia, heart failure, muscle weakness, and dependence on supplemental oxygen. The resident’s history and physical indicated the resident had the capacity to understand and make decisions, and the MDS later identified the resident as cognitively intact and on continuous oxygen therapy. Record review showed no physician order for supplemental oxygen after the resident’s readmission, and there was also no care plan for oxygen administration. Despite this, nursing progress notes documented the resident receiving oxygen by nasal cannula at 3 LPM on 4/08/2026, 2 LPM on 4/10/2026, and 3.5 LPM on 4/29/2026. A physician progress note dated 4/16/2026 stated the resident was improving with supplemental oxygen at 2.5 LPM. During observation on 4/28/2026, the resident was seen receiving 3 LPM of oxygen via nasal cannula. During interviews, LVN 1 stated there was no order for supplemental oxygen and that oxygen is a medication, but the order was not checked and was assumed to exist. The RT also stated there was no order anywhere for supplemental oxygen and acknowledged that administering oxygen without a doctor’s order could be harmful. RNS 1 stated that without a physician order, staff were not following protocol, and MDS stated staff did not obtain an order from the physician and that the physician determines the correct amount of oxygen. Facility policy stated medications shall be administered only upon written order, care plans should start on admission, and comprehensive care plans must be completed within the required timeframe.
