Summary

The facility failed to honor a resident’s rights when it would not accept the resident back after an Emergency Department visit. The resident had been admitted and later readmitted with diagnoses including major depressive disorder, schizoaffective disorder, and anxiety disorder. The MDS dated 3/5/26 showed a BIMS of 15, indicating intact cognition. A record review of the SBAR & Initial COC dated 5/7/26 documented that the resident self-called an ambulance for bladder pain and had a pattern of calling 911 and wanting to go to the hospital every other day or sometimes every day. The same document stated that on 5/5/26 the resident was sent to an acute care hospital for back and neck pain, and that when the resident later approached the nurse stating he was going to the hospital because of bladder pain, the nurse tried to convince him to allow the doctor to order stat labs and a urinalysis, but the resident refused and insisted on going to the hospital and stated he did not trust the facility. During interview, the DON stated the resident was a long-term resident of over a year and had a behavior of calling 911 for non-emergent reasons. The DON stated that on 5/5/26 the resident was transferred to the ED after calling 911 himself, was not admitted to the hospital, and the facility refused to take him back when he was ready to return. The DON stated the facility took the resident’s phone, but he used a friend’s phone, and said, “We wanted to teach him a lesson, that we won't take him back [to the facility].” The DON acknowledged the resident had the right to return to the facility despite any behaviors of calling 911. The facility’s Resident Rights policy stated residents have the right to be treated with respect, kindness, and dignity, to exercise their rights, to be supported in exercising their rights, and to participate in decision-making regarding their care.
