Failure to Follow Two-Person Assistance During In-Bed Care

Summary

The facility failed to ensure staff followed the established care plan and safety protocols for a resident during in-bed perineal care, resulting in the resident falling from the bed to the floor and sustaining serious injuries. The resident had anoxic brain damage, hypoxic ischemic encephalopathy, spastic hemiplegia, morbid obesity, cognitive communication deficit, severe cognitive impairment, and was dependent on staff for toileting, personal hygiene, transfers, and rolling left and right. The resident was also documented as resistive to care and would yell at and hit at staff during care. The resident’s care plan and MDS reflected that she required assistance of two or more helpers to roll left and right, and Kardex documentation showed two-staff assistance for rolling on multiple occasions. The fall investigation and staff interviews showed that a CNA provided perineal care by herself while the resident was in bed. During the care, the resident was rolled onto her side, held onto the bed frame with her left hand, then let go and swatted at the CNA. When the CNA removed her hand from the resident’s hip, the resident slid out of bed from approximately 30 inches high and landed with her left knee on top of the air conditioning unit. After the fall, the resident was screaming and tapping at her left knee indicating pain. She was sent to the hospital, where she was diagnosed with femur fractures in both legs. The left femur was treated with a retrograde nail, and the right femur fracture was later identified and ultimately treated with an above-the-knee amputation for comfort. The facility’s fall investigation described the event and a re-enactment, but the report states it did not include a root cause analysis for how the fall occurred. Interviews also showed staff awareness that the resident often required two aides for perineal care and that she could be difficult to communicate with and resist care.
