Physical Abuse During Incontinence Care Resulted in Femur Fracture

Summary

The facility failed to protect a resident from physical abuse during incontinence care when a nurse aide forcibly continued care after the resident became combative. Resident #1 was admitted with Parkinson’s disease, depression, muscle weakness, hypertension, dementia, and disorientation, and was assessed as moderately cognitively impaired, dependent for transfers, and always incontinent of bowel and bladder. His care plan identified that he was resistive to care, including yelling, screaming, and pushing staff, and directed staff to explain care, allow choice, and leave and return later if he resisted ADLs. On the day of the incident, the resident was found soiled with urine and feces, with blood noted in his brief and on the bed sheet. The nurse aide entered the room to provide care, explained what he was there to do, and began changing the resident. According to the aide’s written statement and interview, the resident became resistant, pushed back, attempted to elbow, punch, and knee him, and the aide responded by giving an extra push, grabbing the resident by the lower thigh and back, and giving a hard push to continue cleaning him. The aide stated he felt a series of pops and then stopped care and reported the situation to the nurse. After the incident, the resident was sent to the hospital with a left leg injury and was placed in traction and given fentanyl during transport. Hospital records showed a closed femur fracture, and the resident received Dilaudid for pain and surgical intervention. Interviews with the nurse, medication aide, police officer, DON, administrator, and medical director confirmed that the aide continued care after the resident became resistive and that the resident suffered a femur fracture during the interaction. The facility’s investigation did not substantiate abuse, but the report documents that the resident’s injury occurred during the aide’s continued physical handling of the resident while providing care.
