Physical abuse of a resident by CNA during behavioral escalation

Summary

The facility failed to ensure one resident was free from physical abuse when a CNA yelled profanity at the resident, grabbed the resident, and pushed the resident to the floor. The resident was cognitively intact, had no hallucinations or delusions, no rejection of care, no impairment to the upper or lower extremities, and diagnoses included seizure disorder, depression, and bipolar disorder. The resident reported that the CNA told him/her to shut the fuck up, grabbed the shirt in the chest area, almost choked him/her, and pushed him/her in the chest, causing the resident to hit his/her head on the door. The incident occurred while the resident was upset about being told not to go out and smoke because the facility was doing resident headcounts after another resident pulled the fire alarm. The CNA stated, I lost my cool, and admitted pushing the resident and grabbing the shirt in the chest area. The CNA said the resident was following him/her around and denied choking the resident, but acknowledged that he/she should have avoided the situation and let the nurse know instead of putting hands on the resident. A witness CNA reported hearing the CNA yell at the resident, seeing the CNA push the resident against the door, and then trying to get the CNA off the resident as the resident slid off and fell to the floor. Staff interviews showed expectations to de-escalate behaviors, separate individuals during altercations, call for help, and report incidents to the nurse. The LPN who responded said the resident was crying and stated that the CNA put hands on him/her, while the SS said staff should know when to tap out when residents had increased behaviors. The DON and Administrator stated staff should walk away, take a break, ask for assistance, and report to supervision when situations escalated. CNA G did not fully include all details in the investigation statement and was terminated after the incident.
