Summary

The facility failed to ensure staff immediately reported an allegation of abuse in accordance with its policy, and the allegation was not reported to DHSS within the required two-hour timeframe for one resident. The facility’s Abuse Prevention and Prohibition policy stated that allegations of abuse, neglect, exploitation, mistreatment, injuries of unknown source, misappropriation of resident property, or other incidents that qualify as a crime were to be reported immediately, but no later than two hours after forming the suspicion, when abuse or serious bodily injury was involved. Resident #1’s MDS showed moderate cognitive impairment, no hallucinations or delusions, no rejection of care behavior, impairment of both upper and lower extremities, dependence with ADLs, and diagnoses including central cord syndrome, cognitive communication deficit, need for assistance with personal care, weakness, and muscle spasms. During an interview, the resident stated that while being changed by a CNA, the CNA put a finger into the resident’s rectum. The resident said the CNA responded, "Oh, sorry my bad," and the resident felt sexually abused because no one else had ever put a finger into the resident’s rectum. The resident also stated the nurse was told and that the resident did not want the CNA to provide care again. The facility investigation showed the resident reported the allegation to a housekeeper, who then reported it to the housekeeping supervisor. The housekeeper later attempted to identify the resident, and the allegation was not escalated until the resident was identified two days later. Interviews with the housekeeper, housekeeping supervisor, regional director of operations, and administrator confirmed the delay in reporting and that the allegation was not reported immediately to the Administrator or to DHSS within the required timeframe. The Administrator stated he expected allegations of abuse to be reported immediately through the chain of command and to DHSS within two hours, and that staff should ensure resident safety, suspend the named staff member, and complete an investigation.
