Failure to Activate Missing Resident Protocol
Summary
The facility failed to follow its elopement and missing resident procedures when a cognitively intact resident with diagnoses including diabetes, bipolar disorder, schizophrenia, chronic respiratory failure, personality disorder, intellectual disabilities, and muscle weakness signed out of the facility and did not return. The resident’s PASSR Level II evaluation documented a history of psychiatric issues, substance use, poor impulse control, high-risk behaviors, and a prior elopement from a hospital. The evaluation also identified the resident’s parent as legal guardian and a sibling as co-guardian, but the resident’s sign-out log showed the resident signed out to go outside with no expected return time listed. Staff later found the resident’s wheelchair outside and could not locate the resident. The report states the facility did not initiate a Code Purple per policy when the resident failed to return for dinner and evening medications and did not return all night. Documentation in the medical record did not show attempts to locate the resident from the time the resident left through several days later, and there was no documentation of communication with law enforcement during that period. The facility’s policy required staff to alert personnel using approved protocol, search for the resident, notify the administrator or designee, contact police if the resident was not found, and notify the DON or designee, physician, and family member or legal representative. The resident’s record also showed the facility did not have admission paperwork from the transferring nursing home, the elopement evaluation on 05/05/26 identified no risk of elopement, and the care plan did not document elopement risk or interventions. The resident’s MAR showed multiple medications were documented as absent from home without meds on the days the resident was missing. Hospital records showed the resident arrived in the ER on 05/11/26 at 8:20 P.M. reporting assault and right ring finger pain with a broken nail, tested positive for marijuana and cocaine, and told hospital staff the resident had left the nursing home a few days earlier due to safety concerns and had stayed with a friend. The guardian told the hospital the resident had eloped from the nursing home, had not been notified when the resident signed out, and was concerned about missed medications and safety. The hospital also documented that police had no missing person report on file when they were contacted to verify the facility’s claim that a report had been filed.
