Summary

The facility failed to report witnessed resident-to-resident physical abuse to the State Agency for two residents who were physically contacted by another resident. The cited resident, who had diagnoses including seizures and dementia and was assessed as having severely impaired cognition, had a pattern of aggressive and boundary-related behaviors documented in progress notes, including guarding his doorway, attempting to be physical with a 1:1 CNA, and making contact with other residents during room-entry incidents. On 1/23/26, staff documented that he made contact with one resident’s face with the palm of his hand, and on 3/12/26, staff documented that he made contact with another resident’s neck with both hands while the resident was leaving his room. During interview, the Risk Management Coordinator stated that if an allegation of abuse was not made by the victim and there was no injury, it would not be reported to the State Agency, although an investigation would be done. She also stated that the Administrator made the decision whether an allegation was reportable. The Risk Management Coordinator acknowledged that the physical altercations involving the two residents were not reported. When interviewed, the Regional Director stated the contact was not considered abuse because it had to be willful, no allegation of abuse was made, and there was no injury. However, staff who witnessed the events described the resident’s actions as unprovoked and aggressive, including one account that he put his hands around another resident’s neck and attempted to choke him, and another that he struck a resident in the face with the palm of his hand. The facility policy required reporting alleged violations to the Administrator and State Agency within required timeframes, including immediately but not later than 2 hours after the allegation when abuse or serious bodily injury was involved.
