Summary

The facility failed to ensure a resident remained free from abuse when a resident-to-resident sexual incident occurred in a room while meal trays were being delivered. Staff observed one resident in another resident’s room with pants pulled down to thigh level and genitals exposed while the other resident was in bed. Facility documentation also stated that a staff member observed the resident rubbing the other resident’s stomach underneath the blanket, and the resident involved was later discharged emergently from the facility. The resident who was exposed had diagnoses including dementia, anxiety disorder, difficulty walking, generalized muscle weakness, and need for assistance with personal care. The resident’s admission MDS showed a BIMS score of 0, and the record indicated the resident was unable to provide responses about the incident. The other resident had diagnoses including dementia, psychotic disturbance, anxiety, cerebral infarction, and amnesia. Review of the record showed that prior to the incident there was no documented care plan for sexually inappropriate behavior, increased supervision, monitoring for sexual behaviors, or interventions related to entering other residents’ rooms without permission. The facility’s records also showed it had prior awareness of concerns about the resident’s sexual behaviors before the incident. Documentation reflected that in August 2025 the facility was contacted about whether it was equipped to manage the resident, and the resident representative reported a prior allegation from another facility involving an inappropriate sexual act. A nursing progress note dated 3/9/2026 documented that the resident entered other residents’ rooms without permission and required redirection, yet no additional monitoring or supervision interventions were in place before the sexual incident involving the two residents.
