Unsafe Mechanical Lift Transfer Resulted in Resident Fall and Serious Head Injury

Summary

The facility failed to ensure a safe environment free from accidents for a resident who required a mechanical Hoyer lift with two staff members for transfers. The resident had cerebral palsy, anxiety disorder, depression, hypertension, impaired lower extremities, used a wheelchair, and was completely dependent on staff for toileting, showering, dressing, and transfers. His care plan directed staff to use a mechanical Hoyer with two staff members and a small red sling for transfers, and his fall risk assessment identified him as a high fall risk. During a transfer from the resident’s electric scooter to bed, two CNAs used a full-body mechanical lift. The scooter became tangled with the lift, and one CNA turned her back to move the scooter while the other moved the lift without hands-on assistance from the first CNA. The resident, who was approximately four feet in the air, began to sway, and one sling loop came unhooked. The resident fell to the floor and sustained a visible head laceration, neck pain, confusion, and later was found to have a concussion, frontal skull fracture, and subarachnoid hemorrhage. The nurse’s note documented that staff found the resident lying on the floor between the lift legs after the incident. The emergency room record stated the resident had been dropped from a mechanical lift and required ICU observation, repeat CT imaging, neurosurgery consultation, and seizure prophylaxis. Staff statements described the scooter becoming stuck, the lift being moved, the resident swinging in the sling, and the sling loops becoming dislodged before the fall. The facility’s investigation concluded the sling loop was not loaded properly when the lift moved forward, and the administrative nurse stated the CNAs did not follow the facility protocol during the transfer.
