Summary

The Facility failed to store food in a manner that prevents foodborne illness. On 3/3/26 at 7:58 AM, the standing refrigerator contained three containers of orange gelatinous substance labeled with R28’s last name, but the containers were not dated or labeled with the contents inside. The Cook reviewed the Facility’s Audit: Food/Beverages Brought into the Facility and identified the items as R28’s orange tapioca gelatin, which had been placed in the refrigerator on 2/22/26. The same refrigerator also contained a clear plastic cup with brown liquid from a retail coffee establishment that was not labeled or dated. Additional food storage concerns were observed in other areas of the Facility. In the walk-in refrigerator, a container labeled beef broth was dated 2/20/26. In the kitchenette refrigerator near the lobby, a bowl of salad covered with plastic wrap was not labeled or dated, and the freezer above contained an opened bag of taquitos that was not resealed and was not labeled or dated. The Dietary Manager stated foods are thrown out three days after preparation and said she had talked to R28 about throwing out the tapioca, but R28 was often resistant and said it was still fine to eat. The Administrator stated she would expect staff to follow Facility policies regarding food storage and labeling. The Facility’s policies required outside food to be kept in airtight containers, labeled with contents and dates, and removed or discarded if not properly labeled.
