Summary

The Administrator failed to follow facility policy and procedures to effectively and efficiently investigate an incident involving a resident who was found on the floor next to her bed and later died. The resident was on hospice, had no previous falls noted, had a BIMS score of 13, and was dependent for most functional and bed mobility tasks. The initial incident report documented that the resident was found on the floor with only skin tears to both elbows, was assessed by nursing staff, hospice was notified, oxygen was applied, and the resident passed away shortly afterward. The police were not notified until the following Monday, despite the facility policy requiring immediate law enforcement notification when a resident death occurs other than by disease processes or when there is reasonable suspicion of a crime causing serious bodily harm. The physician, hospice staff, coroner, and family members later stated they were not informed of key details, including the trash can and trash bag findings, and the pathologist documented that the death was suspicious of suffocation but no police report had been made to that effect.
