Summary

The facility failed to protect residents from sexual abuse and inappropriate sexual contact involving two cognitively impaired residents. One resident with depression, major depressive disorder, and anxiety disorder, and a BIMS score of 12, reported that a man crawled into her bed, placed his hand under her covers, and rubbed her legs while she was asleep. She stated she screamed, told him to leave, and later identified the man as another resident. She also stated she felt intimidated and scared after being awakened by a strange man in her room with his hand under her covers rubbing her legs. The other resident involved had vascular dementia and a BIMS score of 9. Surveyor observation and staff interviews showed that he was able to ambulate independently at times, wandered into other residents’ rooms, and had to be redirected. A CNA stated he could get up and transfer himself to his wheelchair or the bathroom and had been seen wandering into other residents’ rooms. The resident’s care plan did not document any behavioral plan of care. The facility’s incident documentation stated the resident came into the other resident’s room and touched her leg, and that the facility could not determine whether the conduct was sexual in nature. A second abuse-related event involved a cognitively intact resident with a BIMS of 15 who reported that another resident came into her room, placed dirty socks on her bed, pulled down his pants, and felt around in his underwear in front of her. Staff interviews showed the resident had a history of disrobing in common areas and wandering into other residents’ rooms, and that he had been seen pulling his pants down in the hallway. The resident’s care plan also did not document any behavioral plan of care. The facility’s final incident documentation stated the allegation was unsubstantiated, then later acknowledged that the resident did drop his pants and expose his incontinence brief in the presence of the reporting resident, while stating it was unable to determine whether the behavior was sexual in nature.
