Summary
The facility failed to conduct a thorough investigation and report factual information regarding an injury of unknown origin that resulted in a resident’s death, and it failed to investigate allegations of sexual abuse for 3 of 6 residents reviewed for abuse. The resident involved in the death had diagnoses including malignant neoplasm of the bronchus or lung, secondary malignant neoplasm of the liver and intrahepatic bile duct, adult failure to thrive, and anxiety disorder. Her MDS documented a BIMS score of 13, indicating intact cognition, and she required extensive assistance with most ADLs, including toileting, transfers, dressing, bathing, and personal hygiene. Her care plan identified increased fall risk and documented hospice/end-of-life care. On the day of the incident, staff found the resident on the floor beside her bed with her head in a trash can and a plastic trash bag covering her face. Multiple staff and hospice accounts described the resident as lying on her stomach or side, with blood from a skin tear to her arm, and some staff reported a faint pulse while others reported no vital signs. Hospice documentation stated the resident appeared to have rolled out of bed, had her head in a trash can with a trash bag wrapped around her face, and may have suffocated. The facility’s initial incident report described the resident as found on the floor with only obvious injuries being skin tears and stated she was on hospice with no previous falls noted. The investigation file contained typed witness statements that omitted key details documented in handwritten statements and later interviews, including that the resident’s head was in a trash can and that a trash bag was over or in contact with her face. The administrator acknowledged she typed the statements and admitted she left out important details. She also stated she did not tell police about the trash can and trash bag because she felt it was too much information, and she instructed staff not to call the resident’s emergency contacts. The physician stated he was not told about the trash bag over the resident’s face and described the event as a crime scene that should have been reported immediately to police. The report also states the facility failed to investigate allegations of sexual abuse for 3 residents reviewed for abuse.
