Summary

The facility failed to follow its abuse reporting policy by not reporting an allegation of physical abuse to the Illinois Department of Public Health Regional Office for one resident reviewed for abuse. The resident had diagnoses including spastic quadriplegic cerebral palsy, chronic kidney disease, heart failure, mild cognitive impairment, and contracture of the right hand and wrist. The resident also denied knowing whether the facility reported the allegation to IDPH. The CNA denied any abuse and stated the resident’s family member became upset after an interaction at the nurse’s station and later called police alleging the CNA tried to drown the resident. The DON and Administrator stated the facility completed an internal investigation and did not submit an official report to IDPH because the resident could not repeat the family member’s account, the resident was at baseline, and there were no breathing or choking issues. The facility record documented the allegation as resident abuse and noted the family member reported the incident to police, but the report was not sent to the Illinois Department of Public Health Regional Office. The facility policy required any allegation of abuse to be reported immediately, and no later than two hours after the allegation.
