Summary

The facility failed to protect a resident from verbal and physical abuse by another resident during a group activity in the dining room. The abused resident had diagnoses including psychosis, major depressive disorder, mood disorder, paranoid personality disorder, adjustment disorder, delusional disorder, and mild cognitive impairment, while the other resident had diagnoses including paranoid schizophrenia, psychosis, anxiety, intellectual disabilities, hallucinations, delusions, agitation, aggression, major depressive disorder, generalized anxiety disorder, obsessive compulsive disorder, and paranoia. The abused resident was sitting at a dining room table with an empty chair beside them when the other resident approached and tried to move the chair. Witness statements and staff interviews documented that the activity director told the other resident not to move the chair, but the resident continued trying to take it. The resident became upset, yelled at the other resident, called the resident a profane name, and hit the resident on the left shoulder/upper neck area. Multiple residents witnessed the incident, including residents who provided statements describing the yelling, profanity, and physical strike. Staff later confirmed that the resident had a red mark on the left neck/shoulder area and that the other resident had no injuries. The facility also failed to protect another resident from verbal abuse by a different resident during a conflict in a shared hallway and smoking area. One resident had diagnoses including paraplegia, opioid dependence, chronic pain, traumatic brain injury, tobacco use, and adjustment disorder with anxiety, and the other resident had diagnoses including morbid obesity, depression, congestive heart failure, major depressive disorder, tobacco use, and bilateral above-knee amputations. Records and interviews showed the residents had an ongoing conflict, with care plans already noting the need to avoid smoking at the same time. During the incident, the second resident played loud music, used profane and insulting language toward the first resident, blocked the hallway so the first resident could not pass to get to their room, and refused staff direction to move for several minutes. Multiple staff and resident witnesses described the verbal aggression, the hallway blockage, and the first resident turning away and leaving because the path remained blocked.

After the resident was stable for return, the DON and administrator went to the hospital and, along with the owner and corporate administrator on speaker phone, were reported by the resident and hospital staff to have yelled, been rude and aggressive, and told the resident the facility would not take the resident back because of behaviors and money owed. The resident stated feeling pressured, outnumbered, and insignificant.
