Summary

The facility failed to prevent and protect residents from resident-to-resident physical abuse involving two residents, R1 and R2. The incident occurred near the first-floor elevators when the residents became involved in a verbal confrontation that escalated into physical contact. R1 and R2 each gave conflicting accounts of who initiated the altercation, and a third resident also provided changing statements about what happened. Staff members did not witness the actual striking, but they responded after hearing the residents' voices and found the residents already separated. According to the statements documented in the report, R1 and R2 had a prior history of conflict as former roommates. After the resident was stable for return, the DON and administrator went to the hospital and, along with the owner and corporate administrator on speaker phone, were reported by the resident and hospital staff to have yelled, been rude and aggressive, and told the resident the facility would not take the resident back because of behaviors and money owed. The resident stated feeling pressured, outnumbered, and insignificant.
