Neglect on Overnight Shift With Delayed Call-Bell Response and Missed Resident Care

Summary

The facility failed to protect residents from neglect on the overnight shift by not responding timely to call bells, not providing incontinent and toileting care, not completing required rounds, and not providing necessary supervision and assistance on the short-term rehabilitation unit. The deficiency involved two sampled residents, both of whom had care plans that required staff assistance with ADLs, timely call-bell response, and regular toileting or incontinent care. The facility policy stated residents must be free from neglect and that alleged violations must be reported and investigated within required timeframes. Resident #2 had diagnoses including C. Diff, acute kidney failure, adult failure to thrive, weakness, and need for assistance with personal care. The resident’s care plan identified dependence on staff for ADLs, bowel incontinence, and interventions including keeping the call bell within reach, assisting with all ADLs, offering toileting before leaving the room, and providing incontinent care about every two hours and as needed. The resident reported using the bedside commode independently on the overnight shift because the call bell was not answered and no one checked on him/her, that the commode was rarely emptied, that bed sheets were visibly dirty, and that staff did not change them unless requested. The documentation review did not identify overnight bladder or bowel care entries on several dates. Resident #3 had diagnoses including CHF, chronic kidney disease stage IV, acute respiratory failure with hypoxia, weakness, and depression, and was cognitively intact. The resident’s care plan identified ADL deficits, oxygen therapy, a foley catheter, and interventions including catheter care every shift, keeping the call bell within reach, and assisting with all ADLs. The resident reported long waits for the call bell, lack of two-hour safety checks, bowel incontinence that was not assisted with timely, and bed linens not being changed unless requested. Staff interviews described NA staff turning off call bells without responding, not doing two-hour rounds, not toileting residents, leaving residents incontinent overnight, and hiding in the break room or on phones. The DON stated she was unaware of the complaints and that the reported lack of care would have required immediate reporting and investigation.
