Summary

The facility failed to ensure one resident was kept free from abuse and neglect when Resident #10 physically assaulted Resident #15 in the dining room. The incident occurred while other residents were present, and the facility investigation documented that Resident #15 was found on the floor after reporting that Resident #10 hit him and pushed him out of his wheelchair. The investigation concluded that Resident #10 made physical contact with Resident #15, resulting in Resident #15 being on the floor. Resident #15 was cognitively intact with a BIMS score of 15 out of 15, used a wheelchair, and required substantial to maximal assistance with toileting, dressing, and personal hygiene. During the incident, Resident #15 reported that Resident #10 came up behind him, punched him on the right side of the face, and pulled or tipped him out of his high-backed wheelchair. A nurse later documented a small red bump above the right eyebrow, intact skin, no pain, and that the resident was able to move all extremities. Resident #15 stated he did not hit Resident #10 back and said this was the first altercation with him. Resident #10 was severely cognitively impaired with dementia, disorientation, and a history of traumatic brain injury. The resident had a BIMS score of 6 out of 15 and was documented as having inattention and disorganized thinking continuously present. Resident #10 stated he did not remember the altercation, but also said he sometimes looked for a fight when anxious and did not like it when people talked a lot. Facility records documented that Resident #10 believed Resident #15 had taken a paper or money-related item, became angry, and retaliated. Staff interviews confirmed no staff witnessed the incident, and the NHA stated the altercation occurred in the dining room and that Resident #10 was later placed on one-to-one caregiver supervision because of paranoia and escalation.

After the resident was stable for return, the DON and administrator went to the hospital and, along with the owner and corporate administrator on speaker phone, were reported by the resident and hospital staff to have yelled, been rude and aggressive, and told the resident the facility would not take the resident back because of behaviors and money owed. The resident stated feeling pressured, outnumbered, and insignificant.
