Summary

The facility failed to protect the privacy of one of six sampled residents when a nurse practitioner entered Resident 1’s progress note into Resident 2’s electronic health record. The note contained Resident 1’s name, date of birth, medical history, medical diagnoses, physical examination information, and treatment plan. Resident 1 had been admitted with diagnoses including brain dysfunction caused by a chemical imbalance, anxiety, depression, back pain, and a urinary tract infection, while Resident 2 had been admitted with degenerative joint disease in the knee and difficulty walking. During interview and record review, the DON confirmed that Resident 1’s information was inaccurately documented in Resident 2’s EHR and stated it was a violation of Resident 1’s privacy. The MRD also confirmed that the NP incorrectly documented Resident 1’s information in Resident 2’s chart and stated it was important to have correct information in a medical record. Resident 2 stated she requested copies of her own health record and found the progress note for Resident 1, which included personal information about Resident 1. The facility’s policy stated that resident personal and medical records would be protected and access limited to authorized staff and business associates.
