Incomplete informed consent for psychotropic medications

Madera Rehabilitation & Nursing CenterMadera, California Survey Completed on 08-14-2025

Summary

The facility failed to ensure completed physician informed consent was obtained for psychotropic medication use for two sampled residents. Resident 95 had diagnoses including cerebral infarction, epilepsy, stiff-man syndrome, major depressive disorder, and anxiety disorder, and had a BIMS score of 15, indicating cognitive intactness. The resident had an active order for sertraline 50 mg, 0.5 tablet by mouth daily for major depressive disorder, with administration beginning on 7/5/25. The informed consent form for this medication did not show an electronic provider signature, yet the medication was administered daily per the order. Resident 108 had diagnoses including heart failure, atrial fibrillation, hypertension, repeated falls, and schizophrenia, and also had a BIMS score of 15. The resident had an active order for aripiprazole 15 mg by mouth daily for schizophrenia, with the order dated 3/19/25 and the medication started on 3/20/25. The informed consent form for aripiprazole did not include the name of the licensed nurse who prepared the consent form and verified that informed consent had been obtained. During interviews, the LVN stated the provider was responsible for contacting the resident or responsible party and obtaining informed consent, while licensed nursing staff were responsible for ensuring the consent was obtained and documenting the ICPM. The MRA stated the forms were reviewed for completeness, including the licensed nurse name and provider electronic signature, and both residents' forms were incomplete. The DON stated sertraline and aripiprazole required informed consent before administration, that informed consents were legal documents that could not be replaced by a progress note, and that all required elements had to be completed for the document to be valid. Facility policies stated residents must be informed in advance of treatment, including risks, benefits, and alternatives, and that written informed consent with required signatures must be in the record before psychotherapeutic drugs are initiated.
