Communication, Privacy, and Dignity Failures
Summary
The facility failed to protect and promote resident rights related to communication, privacy, and dignity for multiple residents. Resident 2, who spoke Spanish and understood very limited English, and Resident 14, who stated he could not speak English, did not have alternate communication methods observed in their rooms. Resident 2’s responsible party stated the resident relied heavily on pointing and that it was difficult when no Spanish-speaking staff were assigned. Resident 14 told CNA 2 that a picture board would help him communicate his needs, and CNA 2 stated she was not proficient in Spanish medical terminology and would not understand him if he verbalized a medical need. Several residents reported that staff spoke in a foreign language while providing care. Resident 30 stated he had difficulty verbalizing his needs and understanding some staff because they were talking in a foreign language during care. Resident 148 stated staff were speaking in a foreign language during care. Resident 38 stated staff were speaking in a foreign language while providing care to her and her roommate. Resident 50 stated she had the same complaint and found it frustrating not to understand what staff were saying while they provided care. The DON reviewed staffing schedules and stated staff were expected not to speak in a foreign language while providing care and should speak in a language understood by residents so their needs could be met. The facility also allowed three female residents and three male residents to share a bathroom between their rooms. The DSD, CNA 8, CNA 7, the SSD, the DON, and the Administrator all acknowledged the bathroom-sharing arrangement and stated that male and female residents should not share a bathroom and that privacy was a resident right. Family members of affected residents stated they had not been informed of the arrangement. In addition, Resident 4 was observed sitting at a dining table while other residents at the same table were served and began eating, and Resident 4 waited more than five minutes for her food. CNA 10 stated it was not right for Resident 4 to watch other residents eat while waiting for her tray, and the DON stated staff should have notified the kitchen to avoid residents watching others eat while they waited.
