Failure to Provide Needed Mealtime Assistance, Appropriate Call Light, and Skin Care

Summary

Resident 3 did not receive the necessary assistance during mealtimes. Resident 3 had diagnoses including left side hemiplegia and dysphagia, and the MDS indicated set up assistance was needed for eating, with maximal assistance needed for oral hygiene, upper body dressing, and personal hygiene. The care plan also directed staff to assist Resident 3 to set up to eat. During observations, Resident 3’s meal trays remained untouched, including a full boneless chicken with chopped carrots and a full breakfast tray with pancake, sausage patty, milk carton, and coffee. Resident 3 stated the meals were not eaten because assistance was needed to open the milk carton and add milk to the oatmeal and coffee, and Resident 3 said staff did not return after being asked for help. Resident 3 also did not have an appropriate call light to request assistance. Resident 3 had no control over the left upper extremity, could not push the red button on the call light, and had trouble reaching it with the right hand. During observation, the call light was clipped to the left side of Resident 3’s sweatshirt, and Resident 3 had to pull it toward the mouth and use the teeth to operate it. Resident 3 stated the call light was difficult to use and sometimes was not used because it was too much work. The DOR and DON both stated the call light provided was not appropriate for Resident 3, and the DON stated Resident 3 using the mouth to push the call light was not treating Resident 3 with dignity and respect. Resident 3 also had an unaddressed skin issue and mobility assessment concerns. Resident 3’s face was observed to be extremely dry and flaky, with skin flakes visible on clothing during multiple observations. The record review found no care plan and no facial skin assessment in the medical record. The DON stated awareness of the dryness and flakiness but also stated there was no documentation, no physician notification, and no care provided for the skin issue. In addition, the JME dated 3/26/2026 indicated minimal limitation in the left fingers, while the DOR later stated Resident 3 had about 50% range of motion and required more assistance during mealtimes. The DOR stated the rehabilitation department should have completed a more thorough assessment and included the need for more assistance because Resident 3 could not use the left hand during meals and with the call light.
