Failure to Report Injury of Unknown Origin

Summary

The facility failed to follow its abuse prevention and reporting policy when it did not report an injury of unknown origin involving one resident to the state agency and law enforcement within the required time frames. The resident had diagnoses including metabolic encephalopathy, unspecified dementia with anxiety, and long-term anticoagulant use. The resident’s H&P stated the resident did not have the capacity to understand and make medical decisions, and the MDS indicated moderately impaired cognition for daily decision making and varying levels of assistance with activities of daily living. On 4/23/26, staff identified discoloration around the resident’s left eye during breakfast tray delivery. The charge nurse assessed the resident and documented no pain, swelling, open wounds, or distress, and the MD and responsible person were notified. A body check form completed on 4/24/26 also documented around-eye discoloration and discoloration on the left thigh, but staff interviews showed that the left thigh discoloration was not communicated to all relevant nurses at the time. Multiple staff members described the event as related to blood thinners or as an injury of unknown origin, but the resident’s discoloration was not fully investigated as possible abuse at the time it was first identified. The RN supervisor stated a full head-to-toe assessment was not performed on 4/23/26 and acknowledged that abuse was not ruled out as a probable cause. The facility’s own policy stated that injuries of unknown source must be reported immediately and investigated, and that all reports of resident abuse, including injuries of unknown origin, must be reported to local, state, and federal agencies as required. The police later arrived at the facility on 5/2/26 to investigate the incident, and staff stated the matter would be reported to APS.
