Summary

The facility failed to permit a resident to return after hospitalization and failed to follow its Bed-Holds and Returns policy. Resident 5 was initially admitted to the facility, later readmitted, and had diagnoses including paraplegia and depression. His history and physical stated he had the capacity to understand and make decisions, and his MDS showed he was dependent for toileting and lower body dressing. He was transferred to a general acute care hospital after resistance occurred while staff were re-inserting a foley catheter. After the hospital cleared Resident 5 to return, facility staff did not readmit him to the facility. The Director of Marketing and Admission stated she met the resident at the hospital and told him his bed hold had ended and that he would need to return to another room with a roommate because repairs were being done in his original room. She also stated the facility did not routinely review census or bed availability at the time of readmissions and did not assist him with returning to the facility or locating another facility. The DON stated the resident’s room was available when he was cleared for discharge, there were no male/female restrictions, isolation requirements, or other barriers to readmission, and the attending physician and IDT were not involved in the readmission decision. The DON also stated the facility did not issue the required bed hold policy and notification form at the time of transfer and could not explain why it was not provided. The facility policy stated residents and representatives are to receive written notice of bed-hold policies in advance and at the time of transfer, and that residents seeking to return after the bed-hold period are allowed to return to their previous room if available or to the first available bed in a semi-private room. Maintenance records reviewed did not show repair requests for Resident 5’s room, and the Maintenance Supervisor stated repairs to the room’s television and call light had been completed previously on the same day.
