Summary

The facility failed to prevent and appropriately intervene in verbal abuse and neglect by a CNA toward a cognitively intact resident who was dependent on staff for most care. On the date of the incident, the CNA entered the resident’s room to provide care, rummaged through the resident’s personal drawer that did not contain hygiene products, and became irate when questioned by the resident. The CNA began cussing at the resident, told the resident to change themselves despite the resident’s complete dependence on staff for changing and repositioning, and left the resident exposed while walking out of the room. The resident reported feeling threatened when the CNA stated the resident should be careful about how they spoke to staff who served their food and could hear the CNA in the hallway telling other aides not to provide care for them. The resident’s family member reported receiving a phone call from the resident shortly after the incident, finding the resident naked on the bed with no blankets on or around the bed and the call light out of reach upon arrival. The family member stated they submitted a grievance form to the Social Service Assistant within an hour and were told there would be an investigation, but later requested another grievance form because they did not believe an investigation had been completed. The Social Service Assistant did not recall receiving the initial grievance, and the Social Services Director reported receiving a grievance from the family member several weeks later and then beginning an investigation. The Administrator stated they were not aware of the abuse allegation until more than a month after the incident, and the Regional RN confirmed that the incident should have been reported within two hours and that an immediate investigation should have been initiated in accordance with the facility’s Abuse, Neglect, and Exploitation Policy and WAC 388-97-0640(1).
