Summary

The deficiency involves the facility’s failure to promptly notify a resident’s legal guardian of a significant change in condition and transfer to the hospital, as required by facility policy. A cognitively intact resident with diagnoses of schizoaffective disorder, bipolar type, and undifferentiated schizophrenia, who also had a care plan noting impaired thought processes and the presence of a legal guardian, experienced an unwitnessed fall in the dining room while attempting to purchase soda. The resident reported dizziness before the fall, fell into a wheelchair, struck the jaw on the wheelchair, and the chest on the ground. The nurse assessed the resident, monitored vital signs and condition, identified and treated wounds, and suspected a possible head injury. The acting DON and Nurse Practitioner were notified, and the resident was transferred to the hospital for further evaluation and treatment. Despite these events, there was no documentation that the legal guardian was notified at the time of the incident or prior to the resident’s hospital transfer, contrary to the facility’s Incidents and Accidents Policy, which requires notification of the family or representative and documentation of such notification. The legal guardian reported not being notified timely that the resident was in the hospital and stated the hospital was not informed that the resident had a legal guardian on admission. The LPN who cared for the resident at the time of the fall acknowledged not calling the legal guardian when the incident occurred, instead calling the following day, and also acknowledged failing to document that call. Facility leadership, including the DON and Administrator, confirmed that staff were expected to notify legal guardians as soon as possible after an incident, generally within thirty minutes and before leaving the building, which did not occur in this case.
