Summary

The deficiency involves the facility’s failure to protect a cognitively intact resident from sexual abuse by another resident. Hospital records for the victim showed only a general checkup with no new orders, and the other resident’s psychiatric evaluation resulted in his return to the facility. The facility’s abuse policy defines sexual abuse as nonconsensual sexual contact of any type with a resident, including unwanted intimate touching of the breasts, which aligns with the conduct described in this case.
