The facility failed to prevent resident-on-resident physical abuse when one cognitively intact resident with bipolar disorder and a history of other mental and behavioral disorders reported being punched by his cognitively intact roommate, who had diagnoses including aphagia, bipolar disorder, mood disorder, right-sided hemiplegia, and anxiety. The administrator and DON acknowledged that the alleged victim, who was described as schizophrenic and bipolar and very manic and moving throughout the facility in the weeks before the incident, had reported that multiple residents and staff had witnessed the assault, though those individuals later denied witnessing it when interviewed. The LPN’s nursing notes documenting the assessment of both residents after the allegation were left in draft status rather than being finalized in the medical record. These actions and inactions occurred despite the facility’s abuse policy stating a commitment to protect residents from abuse and mistreatment by anyone, including other residents.
