Summary

The facility failed to protect a resident from abuse by another resident when it did not prevent or adequately manage a resident-to-resident altercation that met the facility’s own definition of physical abuse. The facility’s Abuse Prevention and Reporting policy, revised 10/24/22, prohibits abuse, including physical abuse such as hitting, slapping, pinching, kicking, and controlling behavior, and specifies that resident-to-resident altercations involving willful actions resulting in physical injury, mental anguish, or pain must be reported. One resident (R2), who was cognitively intact with documented delusions, hallucinations, and frequent verbal and physical behaviors, had a care plan noting a history of making inappropriate comments and gestures toward female staff and residents, and a history of being physically and verbally aggressive, whether provoked or unprovoked. Despite this known history, R2 was involved in an altercation with another resident (R1) in which R2 willfully grabbed R1’s beard while R1 grabbed R2’s shirt. According to the facility’s Final Abuse Investigation Form dated 2/22/2026, a former employee observed the two residents making physical contact, with R2’s hand on R1’s beard and R1 holding R2’s shirt, and intervened to separate them. R2 later stated he and R1 did not like each other and described an incident where R1 got in his way, they yelled at each other, and he grabbed R1’s beard while R1 grabbed his shirt. R1 reported that R2 reached out, grabbed his beard, and cursed at him, and that the beard pulling was very painful. The Administrator confirmed that, under the facility’s policy, a resident willfully pulling another resident’s beard is considered abuse. The incident, involving willful physical contact causing pain between residents with a known history of behavioral issues, demonstrates the facility’s failure to ensure that R1 was free from abuse by another resident as required by its policy and regulatory standards.
