Failure to Follow Kitchen Sanitation and Hair Restraint Policies

Legacy Hilo Rehabilitation & Nursing CenterHilo, Hawaii Survey Completed on 02-27-2026

Summary

The facility failed to follow its kitchen sanitation and dietary dress code policies, resulting in improper food handling practices. During a kitchen observation on 02/24/26 at 10:15 AM, a scooper utensil was found left inside a sugar container instead of being properly stored, contrary to the facility’s policy requiring proper utensil storage and handling. A subsequent kitchen observation on 02/25/26 at 01:15 PM revealed that two kitchen staff members were working near the food preparation area without wearing required hair restraints, despite the dietary dress code policy stating that effective hair restraints must be utilized while working in the dietary department and that hairnets, beard guards, or bonnets are available at department entrances and exits. In a staff interview on 02/25/26 at 01:20 PM, the Dietary Director acknowledged that the scooper utensil should not have been left in the sugar container and confirmed that kitchen staff are required to wear hair restraints at all times while working in the department. The report notes that, as a result of these deficiencies, there was an increased risk for foodborne illness and impact on quality of service.
