Failure to Assess and Offer Updated COVID-19 Vaccines
Summary
The facility failed to offer the 2025-2026 COVID-19 vaccine to three sampled residents after admission because staff did not fully assess each resident’s COVID-19 vaccine history. Facility policy stated residents or their representatives were to receive education about the vaccine, be offered the vaccine unless previously immunized or medically contraindicated, and have COVID-19 vaccine status obtained on admission. However, the admission assessments for Resident #5, Resident #13, and Resident #12 only documented that each resident said they had received a COVID-19 vaccine, and staff did not obtain the date of the most recent vaccine to determine whether an updated vaccine was due. Resident #5 was admitted with a history of pulmonary fibrosis, COPD, mitral valve disease, and persistent atrial fibrillation, and had intact cognition with a BIMS score of 15. The record showed prior COVID-19 vaccinations in 2021, 2022, and 2023, but no documentation that an updated 2025-2026 vaccine was offered after admission. Resident #5 tested negative for SARS-CoV-2 after admission and later tested positive for COVID-19. Resident #13 was admitted with acute on chronic respiratory failure, CHF, CAD, type 2 diabetes, and CKD, also had a BIMS score of 15, and had prior COVID-19 vaccinations documented in 2021 and 2022. The record did not show that an updated vaccine was offered after admission, and Resident #13 tested positive for COVID-19 after admission and had increased fatigue and cough noted in a physician progress note. Resident #12 was admitted with type 2 diabetes, obstructive sleep apnea, hypertension, and obesity, had intact cognition with a BIMS score of 15, and had no documented prior COVID-19 vaccine in the immunization history. Even so, the admission assessment documented only that the resident said yes when asked about having had a COVID-19 vaccine, and staff did not verify the date or offer an updated vaccine. The facility also failed to offer 2025-2026 COVID-19 vaccines to current staff. The Infection Preventionist stated the facility no longer offered COVID-19 vaccinations for staff because it was no longer mandated.

Consultant Staff HH stated that vaccine education was completed verbally during the education.

His MDS indicated that pneumonia and COVID-19 vaccinations were not up to date, but his care plan did not address immunizations and his electronic medical record also lacked immunization documentation. During interview, the ADON stated the facility did not have consent forms for Resident #65 and that the medical record did not contain vaccine information. She said the resident was combative and not agreeable at times, and that the facility would call the family to obtain consent or ask whether he had received the vaccines. The DON stated immunization history should be completed as soon as records are received and that if vaccine data was not available, it should be documented in the nurse's note. The Unit Manager for Resident #3 stated the admitting nurse was responsible for screening for vaccinations and that if the resident refused immunizations, it should have been documented. The Infection Control Nurse and Education Coordinator stated the admitting nurse was responsible for screening residents for immunizations and offering the vaccine.

On 06/24/26, the NHA and DON acknowledged the regulation requiring documentation of screening, education, offering, and current COVID vaccination status for staff. The DON stated they were unaware this was not being done and said the facility used to maintain this information, with the expectation that the Infection Preventionist would maintain the required documentation for all staff.

CNA 8 stated she could not remember the last time she received information or was offered a COVID-19 vaccination at the facility and said COVID-19 had not been brought up in recent years. The DNS reviewed the facility policy titled, Coronavirus Disease (COVID-19)-Vaccination of Staff, dated May 2024, and stated the facility provided COVID-19 education and vaccination only at orientation upon hire and did not continue ongoing education or offer the vaccine after the initial orientation period. The DNS also stated the facility's policy was not being followed.

When asked for documentation for one sampled employee and then four additional sampled staff members, the Infection Preventionist said the facility did not keep employee records of SARS or COVID-19 vaccine education, or records showing whether employees had received the SARS or COVID-19 vaccine. Nurse Consultant #1 also stated the facility had not documented whether the five sampled staff had declined or been administered the COVID-19 vaccine.
