For one resident, the record showed a POLST signed by the resident, physician, and RN indicating DNR, DNI, DNH, and comfort measures only, with no artificial hydration or nutrition by tube. The resident had been in the facility since 2021, had moderate cognitive impairment, and diagnoses including CVA, diabetes mellitus, and hyperlipidemia. During an acute decline with fever, respiratory distress, elevated blood pressure, tachycardia, hypernatremia, and chest X-ray findings suggestive of pneumonia, the resident’s representative was notified of the resident’s condition and interventions. On January 8, 2026, Social Services notified the DON that the guardian had changed the code status to full code, and the resident was sent to the hospital. The social worker stated she acted on the guardian’s verbal instruction without obtaining proper documentation, verifying authority, or ensuring a physician-signed POLST update, and she could not locate a second POLST form that she believed existed. For the second resident, the record showed admission with heart failure, protein-calorie malnutrition, and cerebral infarct, with severe cognitive impairment on MDS. The resident’s POLST, signed by the resident and representative, indicated DNR, DNI, DNH, and comfort measures only. After the resident was found on the floor with a hematoma to the head and nose area, an agency nurse called 911 and sent the resident to the ER without following the POLST and without obtaining an order for transfer. The facility investigation stated the agency nurse did not follow the resident’s POLST for DNR/DNI/DNH, and the DON confirmed that the POLST was not followed.

A family member reported that the resident had a decline in health about a week before hospitalization, with severe UTI and stool impaction. The hospital record documented that the resident arrived from the nursing home via EMS with confusion and altered mental status that had worsened since several days earlier, and the ED physician suspected sepsis. The resident was febrile, tachycardic, had elevated white blood cell count and creatinine, and was diagnosed with proctitis, cystitis, sepsis, NSTEMI, and acute kidney injury. The urine culture was positive for gram-negative rods/Pseudomonas aeruginosa. For another resident with diagnoses including diabetes mellitus, a history of UTIs, CHF, Alzheimer's disease, and dementia, the progress notes showed family concerns about abnormal behavior, confusion, agitation, shortness of breath, congestion, lethargy, and shallow breathing. The resident's DPOA reported repeatedly expressing concern that something was wrong and requesting hospital evaluation, but the facility did not immediately send the resident out and instead contacted the physician first. The change-in-condition documentation noted altered mental status and respiratory symptoms, and the physician initially recommended a nebulizer treatment before later directing transfer to the ED. The resident was admitted to the hospital with bilateral pneumonia, acute hypoxic respiratory failure, likely demand ischemia, chronic diastolic CHF, fluid overload, severe anemia, and human metapneumovirus infection.
