Summary

The facility failed to prevent two accidents involving a sit-to-stand mechanical lift and failed to remove the malfunctioning lift from use until after surveyor inquiry. One resident with multiple sclerosis, depression, and anxiety was assessed as cognitively intact, dependent for transfers, and requiring either a sit-to-stand lift or two-person assistance. The resident stated that the lift had not been operating well for several days, that staff sometimes kept them in bed because of the problem, and that transfers were delayed when the lift did not work. The resident also reported that the lift had injured them in a prior incident when staff did not operate it correctly. The resident described one prior accident in which a foot became caught under the sit-to-stand platform during a transfer, causing the toenail to come off and resulting in an open wound that took time to heal. The resident said the aide moved too quickly and did not position the foot correctly. The progress note for that incident documented that the resident’s foot was caught under the lift, the toenail was bleeding and coming off, and wound care and physician notification were required. A later progress note also documented another conflict involving the same resident and malfunctioning transfer equipment when staff were unable to transfer the resident because the lift was not working. During the survey, staff could not locate the sit-to-stand lift, and the DON and Maintenance Director acknowledged that the only sit-to-stand lift in the building was not functioning and had been removed from circulation only after the concern was brought to their attention. The DON stated staff and nursing management had not made them aware the lift was unsafe, and the Maintenance Director confirmed no concerns had been reported to maintenance. The resident’s care plan and room posting indicated the resident was to use the sit-to-stand lift for transfers and toileting, and the resident stated they felt safest with that device because of leg weakness related to MS.
