Summary
The facility failed to ensure that residents were able to identify the grievance officer, were given a copy of the grievance policy, and were informed of the progress and resolution of their concerns. During a group meeting with alert and oriented residents, multiple residents reported that they had not been given a copy of the grievance policy. They also stated that they could not identify the grievance official by sight or by name and did not know the person’s business address or phone number. The Administrator confirmed that the name and business contact information for the staff member responsible for grievance officer duties was not visually readily accessible or posted in prominent locations throughout the facility. A documented grievance for Resident R120 involved a concern about delayed morning care and the attitude of a nursing staff member. Resident R120 reported not receiving assistance with morning care and activities of daily living until 12:30 p.m. and missing coffee hour, which the resident enjoyed daily. The resident’s clinical record showed the resident was oriented to time, place, and person, had fair judgment, was an early riser, and required substantial assistance with dressing, personal hygiene, transfers, and mobility. The grievance summary stated the concern for lack of necessary and timely care was not verified, but the rationale documented that the resident and a nursing assistant both stated timely assistance with dressing, personal hygiene, toileting, and transfers was not provided. A separate grievance for Resident R41 involved a family concern that the resident had not had a shower or bath and smelled of body odor, feces, and urine. The resident’s record showed cognitive intactness, total dependence for personal hygiene, bathing, toileting, eating, and transfers, and bowel and bladder incontinence. The grievance summary concluded the concern was unsubstantiated, but the rationale stated the concern was verified by the resident, who reported refusing care because of discomfort with certain nursing assistants, a preference for male staff for incontinent care and bathing, and a preferred soap that the facility did not use. The record and interviews also confirmed the resident required a mechanical lift for transfers and assistance of two or more staff for incontinence care, and there was no documentation that the facility made prompt efforts to investigate and reasonably resolve the grievance for the resident and family member.
