Failure to Provide Behavioral Health Care and De-escalation for an Aggressive Resident

Summary

The facility failed to provide necessary behavioral health care and services for one resident with a significant behavioral health history and multiple mental health diagnoses, including Asperger's syndrome, paranoid schizophrenia, major depressive disorder, anxiety disorder, mild intellectual disability, impulse disorder, obsessive compulsive personality disorder, schizoaffective disorder, and dissociative identity disorder. The resident's PASARR indicated behavioral difficulties and/or mental illness symptoms requiring 24-hour monitoring and management, psychiatric follow-up, medication administration and monitoring, a secure behavioral unit, and assessment of the level of supervision needed to prevent harm to self and others. The resident's care plan identified behavioral challenges, triggers, and interventions such as counseling, 1:1 intervention as needed, pharmaceutical interventions as needed, calm communication, music, reading the Bible, smoking, and showering. After multiple escalated behavior incidents, staff did not implement the resident's plan of care, did not document behavior monitoring, and did not document use of nonpharmacological interventions or the ordered PRN chlorpromazine for agitation/anxiety. Following one incident in which the resident kicked through the front doors, threw a shampoo bottle at a television, charged at staff, and was placed in a hold, the record showed no urinalysis or CBC completed as noted in the investigation, and the care plan was not reviewed or updated. Staff interviews indicated clinical staff were not present to monitor or de-escalate the resident during the incident, and the resident continued to have escalated behaviors afterward. The resident was involved in repeated resident-to-resident altercations in which the resident was the aggressor and sustained or caused injuries. The resident punched another resident in the back of the head, struck another resident with a mop stick, and later pushed another resident to the floor, resulting in a rib fracture. Other incidents resulted in bruising, scratches, red marks, a bleeding laceration to the lip, and a black eye. Staff interviews showed that code green responses were delayed or not initiated until after residents were already physical, staff were unsure how to respond, and the resident was not placed on intensive monitoring or given PRN medication after the incidents. The record also showed no implementation of the resident's individualized behavioral interventions or PASARR recommendations after the behaviors escalated.
