Failure to Provide Accessible Grievance Process and Retain Grievance Records
Summary
The facility failed to ensure residents had the right to voice and formulate grievances, have grievances responded to promptly, and receive a resolution. The facility’s grievance policy identified the administrator as the grievance official and stated that residents, representatives, family members, employees, or advocates could file grievances without fear of discrimination or reprisal. The policy also stated that staff would inform residents or their representatives of the grievance process, assist with filing a written grievance using the grievance form as needed, allow anonymous grievances to the extent possible, and maintain evidence of grievance results for three years. During a resident group meeting with 13 residents, 11 residents said they were not sure of the process for completing a grievance form, where the forms were located, or who the grievance officer was. Nine residents said they were not sure what would be considered a grievance or how to formulate a grievance anonymously. The surveyor toured the building and did not find information posted about the grievance process. An empty green folder labeled grievances was observed in the lobby, and the surveyor also did not find information on how to file a grievance, how to file anonymously, or who was responsible for the grievance process. Staff interviews confirmed grievance forms were kept behind the enclosed nurses’ station and were not accessible to residents or visitors without asking staff for help. Nurses and other staff were unsure of the grievance process, where forms were located, who the grievance officer was, and how anonymous grievances would be handled. The administrator stated he was the grievance officer and expected staff to assist residents, but he was not aware there was no process in place for anonymous filing. In addition, the facility could not provide three years of resolved grievance records and was unable to produce grievances before 1/2025; the grievance book provided only covered May 2025 through December 2025, and staff stated they expected grievance records to be retained for three years after resolution.
