During a concurrent interview and record review, Resident 8’s POLST dated 11/25/2019 indicated the resident had an AD, while the ADAF dated 7/3/2023 indicated the resident did not have an AD. The DON stated there was no AD in the medical chart and that the POLST and ADAF contradicted each other. The DON stated the POLST should be updated to reflect that Resident 8 did not have an AD, and the SSD stated the information was confusing and should match. For Resident 41, the record showed admission and readmission with diagnoses including osteoarthritis and schizophrenia. The MDS indicated intact cognition, shortness of breath when lying flat, and tobacco use. The POLST and ADAF both indicated an AD dated 8/5/2013 was available and reviewed, and the SSA stated the AD was completed and witnessed by the former SSD. However, the DON stated the AD was not in the medical record and should be available in the chart, and the SSD confirmed the AD was not in the chart even though the forms indicated it existed. For Resident 5, the H&P indicated the resident had capacity to make medical decisions and was on DNR status, and the MDS indicated the resident could make self understood and understand others. The medical record contained an AHCD dated 8/15/2022, but the AHCD Acknowledgement Form dated 7/28/2025 and the SSA dated 10/20/2025 both indicated the resident did not have an AHCD. The DON stated the acknowledgement form should have been updated to indicate the resident did have an AHCD on file.

The deficiency was identified during review of Complaint #3035494 and involved delayed responses to worsening symptoms, resulting in delayed medical treatment, worsening of condition, and dissatisfaction with care. For one resident with diagnoses including Alzheimer's disease and other medically complex conditions, the record showed severely impaired cognition and inability to make decisions. A family member reported that the resident had a decline in health about a week before hospitalization, with severe UTI and stool impaction. The hospital record documented that the resident arrived from the nursing home via EMS with confusion and altered mental status that had worsened since several days earlier, and the ED physician suspected sepsis. The resident was febrile, tachycardic, had elevated white blood cell count and creatinine, and was diagnosed with proctitis, cystitis, sepsis, NSTEMI, and acute kidney injury. The urine culture was positive for gram-negative rods/Pseudomonas aeruginosa. For another resident with diagnoses including diabetes mellitus, a history of UTIs, CHF, Alzheimer's disease, and dementia, the progress notes showed family concerns about abnormal behavior, confusion, agitation, shortness of breath, congestion, lethargy, and shallow breathing. The resident's DPOA reported repeatedly expressing concern that something was wrong and requesting hospital evaluation, but the facility did not immediately send the resident out and instead contacted the physician first. The change-in-condition documentation noted altered mental status and respiratory symptoms, and the physician initially recommended a nebulizer treatment before later directing transfer to the ED. The resident was admitted to the hospital with bilateral pneumonia, acute hypoxic respiratory failure, likely demand ischemia, chronic diastolic CHF, fluid overload, severe anemia, and human metapneumovirus infection.
