However, the electronic health records for R11, R13, R32, and R35 did not include evidence that the resident or the resident’s representative received education regarding pneumococcal vaccine booster information, and there was no indication that the vaccine was offered per CDC guidance. R11 had diagnoses including Alzheimer’s disease, heart failure, type 2 diabetes, obesity, and hypertension, and immunization records showed prior PPSV23 and PCV13 doses. R13 had vascular dementia, sleep apnea, type 2 diabetes, and hypertension, with records showing PCV13 and another pneumococcal vaccine dose that was not identified. R32 had dementia, chronic kidney disease, and congestive heart failure, with two pneumococcal vaccine doses documented but not identified by type. R35 had dementia, hypertension, and left-sided hemiplegia and hemiparesis, with documentation of PCV13 and PPSV23. During interview, the LPN stated that when residents had received PCV13 and PCV23, they were considered complete and PCV20 or PCV21 was not required, and because of this R11, R13, R32, and R36 were not offered PCV20 or PCV21. The facility policy stated residents were to be offered pneumococcal immunization in accordance with current CDC guidelines and that education regarding benefits and potential side effects was to be documented in the clinical record.

Resident 56 stated on 6/5/26 that she would have wanted to have been offered the pneumococcal vaccination. Resident 7 was admitted in 4/2024 with diagnoses including chronic heart failure and diabetes. Records showed the resident last received PCV13 on 7/17/17, with no pneumococcal vaccination consent after that date and no documented evidence that the resident was offered or declined PCV20 or PCV21. Resident 7’s 4/30/26 Quarterly MDS indicated severe cognitive impairment. Staff 15, the Infection Preventionist, stated she had developed a tracking system and found residents were past due for vaccinations, knew Resident 7 and Resident 56 were due for pneumococcal vaccinations, but had not offered them. Staff 15 stated she struggled completing past due vaccinations because she was pulled to other nursing and staffing coordination tasks. Staff 2, the DNS, confirmed knowing Staff 15 was working on past due vaccinations but did not confirm knowing specific residents.

Resident #115 was admitted with end stage renal disease, and the record review did not reveal cognition or immunization status information in the entry MDS. For both residents, the immunization tab in the electronic medical record showed no data available, and the care plans did not include immunization information. During interviews, the ADON, who said she was the facility’s Infection Preventionist, stated residents were asked on admission about flu, pneumonia, and COVID vaccines and that refusals should be documented. She said immunization information should have been entered in the electronic medical record or admission packet and that she was responsible for entering vaccine information. The DON stated obtaining immunization information fell to the infection control nurse, though nursing management and admitting staff could also assist. The DCE and Administrator stated the admission packet contained vaccine information and consents and that admissions paperwork was the responsibility of the DCE or Admissions, but the DCE was new to the facility and the prior DCE had left before the current one started.
Failure to Offer Influenza and Pneumococcal Vaccinations

Record review and facility documents showed both residents had personal immunization histories indicating prior pneumococcal vaccination, with the facility documenting them as up to date on pneumococcal vaccines. During interview on 05/29/26, the DON confirmed that R73’s and R76’s pneumococcal vaccines were not up to date after reviewing CDC guidelines, and stated there was no documented evidence that either resident was offered an influenza vaccine and accepted or declined it. The facility policies titled Pneumococcal Vaccination (Series) and Influenza Vaccination stated that residents are to be offered immunization in accordance with current CDC guidelines and annual influenza vaccination guidance.
