Summary

The facility failed to ensure that an allegation of misappropriation of a resident’s property was reported to the Office of Health Care Quality as required. During review of Facility Reported Incident 358648, it was found that an RN misappropriated Resident #76’s oxycodone from the medication cart in August 2024 after the resident had been discharged from the facility. The RN documented the medication as wasted, and an LPN cosigned the narcotic sheet even though she stated she did not physically observe the destruction of the medication. The DON stated that after the resident contacted the facility about the missing medication, an internal investigation was started, the RN tested positive for oxycodone use, and the RN was terminated and reported to the Maryland Board of Nursing. The facility did not report the misappropriation/diversion of controlled medication to OHCQ, and the Corporate Nurse stated it was not reported because it was discovered after the resident had discharged.
