Failure to timely report and investigate suspected abuse and criminal incidents
Summary
The facility failed to develop and/or implement policies and procedures to ensure reporting of a reasonable suspicion of a crime in accordance with section 1150B of the Act for five residents reviewed. The deficiency involved incidents in which resident-to-resident interactions were not reported to the State Agency within the required two-hour timeframe, and one incident was not reported or investigated as an allegation of abuse. The facility policy stated that alleged violations must be reported to the state agency and other required agencies within specified timeframes, including immediately but not later than 2 hours after the allegation is made when abuse is involved or when serious bodily injury results. One incident involved a resident with dementia and severely impaired cognitive skills who struck another resident in the dining room. The incident occurred at 11:45 a.m., but the facility reported it to the State Agency at 3:11 p.m., which was 1 hour and 26 minutes later than the two-hour reporting guideline. Law enforcement was not contacted until 8:52 p.m., after the incident had already been reported to the State Agency. The record showed the facility had not ruled out abuse or a criminal act before police contact. A second incident involved a resident with severe cognitive impairment who was documented as yelling at another resident in the dining room, causing the other resident to appear startled. The nurse later stated she only heard yelling and saw the other resident leaving the dining room, and she did not ask follow-up questions about what occurred or whether any physical contact had happened. The facility did not investigate or report this event as an allegation of abuse. A third incident involved one resident with severe cognitive impairment placing a hand under another resident's shirt and touching her breast while they were kissing in a common area. That incident occurred at 12:30 p.m., but the facility did not report it to the State Agency until 7:53 p.m., 5 hours and 23 minutes later than the two-hour guideline, and law enforcement was contacted at 4:57 p.m. The DON also stated that no assessment had been obtained to determine either resident's capacity to consent to sexual relations.
